Market Ralph is operated by Rafael Echavarria, an individual based in Prague, Czech Republic, currently completing registration as a self-employed person (OSVČ / živnostenský list). These terms will be updated with a business registration number (IČO) once issued.
In these terms, "we", "us" and "Market Ralph" mean that business. "You" means the person or organisation engaging us or using this website.

These terms apply to your use of this website and to any services we provide, including free and paid work. Where we agree separate written terms with you for a specific engagement — in a proposal, quote or contract — those terms take precedence over these, and these terms fill any gaps.
The prices and delivery timescales published on our Services page are indicative and reflect the scope described there. An engagement begins only when we have confirmed the scope, price and delivery date with you in writing and you have accepted it. Until then, nothing on this website constitutes a binding offer.
Delivery timescales are working-day estimates and assume we receive what we need from you promptly. Delays in access, information or feedback move the delivery date accordingly.
Fees are fixed at the point the engagement is confirmed and are quoted in EUR unless otherwise agreed. Invoicing in CZK is available on request. Unless we agree otherwise in writing, invoices are payable within 14 days of issue.
We are not currently VAT registered. If that changes, VAT will be applied and stated separately on invoices from that point onward.
Most of our work depends on information and access that only you can give us. You agree to provide, promptly and accurately:
Our findings are based on what you give us. If the underlying data is incomplete, misconfigured or inaccurate, our conclusions will inherit those limitations, and we are not responsible for conclusions drawn from data we could not verify.
We provide professional analysis, opinion and recommendations. We do not guarantee any particular outcome, and nothing we produce should be read as a promise of results.
Specifically, we do not guarantee any level of traffic, leads, conversions, cost per lead, return on ad spend, pipeline, revenue, search ranking, or visibility in any search engine or AI assistant. Marketing performance depends on factors outside our control, including your offer, your pricing, your sales process, your competitors, market conditions, and how our recommendations are implemented.
Our work frequently involves platforms operated by third parties, including Google, LinkedIn, Meta and analytics providers. Those platforms change their policies, algorithms, features, reporting and pricing without notice, and may suspend or restrict accounts for reasons neither of us controls.
We are not responsible for those changes or for their effect on your results, and we are not responsible for any decision a platform makes about your account.
Unless implementation is expressly part of the agreed scope, our deliverables are recommendations for you or your team to execute. We are not responsible for how recommendations are implemented, for partial implementation, or for outcomes where recommendations were not followed.
The free teardown is offered without charge and without any obligation on either side. It is a brief, high-level review, not a comprehensive audit, and it is provided as-is. We may limit the number we accept, decline any request, or withdraw the offer at any time.
Because no fee is paid, we accept no liability of any kind in connection with the free teardown, save for liability that cannot be excluded by law.
On payment in full, you own the deliverable produced for you and may use it freely inside your organisation, including sharing it with your staff, contractors and advisers.
We retain ownership of our underlying methods, frameworks, templates and know-how, and remain free to use them for other clients. Nothing in an engagement transfers those to you or prevents us from working with others, including in your sector.
We treat non-public information you share with us as confidential and will not disclose it to third parties except where you agree, or where we are legally required to. This obligation continues after the engagement ends.
We will not publish your name, logo or results as a case study without your written permission. Where founding-client pricing is offered in exchange for a published case study, the scope of what may be published will be agreed with you in writing before anything is published.

Nothing in these terms excludes or limits liability where it cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud, or for damage caused intentionally or through gross negligence.
Subject to that, our total liability arising out of or in connection with an engagement, whether in contract, tort or otherwise, is limited to the total fees you have actually paid us for that engagement.
We are not liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill, anticipated savings, or data.
You may cancel an engagement before work begins at no cost. Once work has begun, fees for work already carried out remain payable, calculated proportionately to the work completed.
Separately, and as stated on our Services page: if a diagnostic engagement produces no finding you can act on, you do not pay for it. Whether that applies is determined reasonably and in good faith, and it does not apply to implementation, retainer or fractional engagements.
These terms are governed by the laws of the Czech Republic, and the courts of the Czech Republic have exclusive jurisdiction over any dispute arising from them.
Our services are offered to businesses and professionals rather than consumers. Where mandatory consumer protection law nevertheless applies to you, it takes precedence over anything in these terms that conflicts with it.
We may update these terms as the business evolves. The version in force for an engagement is the version published when that engagement was confirmed. The "Last updated" date at the top of this page always reflects the current version.
